Illinois child custody laws do not have a bias toward mothers or fathers in divorce cases involving child custody disputes. The guiding principle in all child custody matters is the best interest of the child. Often there are conflicting points of view on what is in the interest of the child. Our child custody attorneys work closely with our clients to assure that the interests of their family and their children are well represented.

Under Illinois child custody laws, children do not have the discretion to choose which parent will be their custodial parent or residential parent and which will be their non-custodial parent. However, depending on the age and maturity of the child, their wishes can play a role in determining custody orders.

Experienced Visitation or Parenting Time Attorneys

Regardless of which parent is granted physical custody of the children, the non-custodial parent is almost always granted visitation. Parenting time arrangements are often negotiated between the parents and approved by the courts. These agreements include a specified schedule that can only be deviated by agreement. However, when the parents cannot agree, visitation schedules can be imposed by the court. Visitation violations are a misdemeanor and can result in arrest, jail time, and orders of protection. In addition to helping parents with visitation issues, our attorneys have pursued grandparent’s rights to visitation.
